1. Commitment to Copyright Protection

Pawsome Plate respects the intellectual property rights of creators, photographers, authors, and researchers. It is our policy to respond expeditiously to legitimate notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act (“DMCA”).

2. Filing a DMCA Notice of Infringement

To submit a valid DMCA takedown notice, please provide our Designated Copyright Agent with a written communication containing all of the following statutory elements (as required by 17 U.S.C. § 512(c)(3)):

  1. Identification of the Copyrighted Work: A description of the copyrighted work that you claim has been infringed (or, if multiple works, a representative list).
  2. Identification of the Infringing Material: The exact URL (web link) on PawsomePlate.com where the allegedly infringing material is located, with sufficient detail so we can identify and remove it.
  3. Your Contact Information: Your full legal name, mailing address, telephone number, and email address.
  4. Good Faith Statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. Statement of Accuracy Under Penalty of Perjury: A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. Physical or Electronic Signature: A physical or electronic signature of the copyright owner or authorized representative.

Note: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages, including court costs and attorneys’ fees.

4. Counter-Notification Procedure

If material you posted was removed or disabled as a result of a DMCA notice and you believe this was due to mistake or misidentification, you may submit a written Counter-Notification to our Designated Agent. The counter-notice must include:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or disabled, and the location where it appeared before removal.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • Your name, address, telephone number, and a statement consenting to the jurisdiction of the Federal District Court.

5. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, Pawsome Plate maintains a strict policy of terminating, in appropriate circumstances, user accounts or access for users who are deemed repeat copyright infringers.
